NOTICE OF CERTIFICATION ANNEXATION PETITION FOR ROUND VALLEY ANNEXATION On March 11, 2013, Park City Municipal Corporation and co-petitioners Afton Stephen Osguthorpe and UDOT, jointly filed a petition proposing annexation into Park City of 1,367.94 acres of metes and bounds described properties, including 1) the 1,104.39 acre north area consisting of the Round Valley open space area and 2) the 263.55 acre south area of City owned open space south of the Ability Center and the Quinn\'s Sports Complex along with the Osguthorpe owned fields and eight small parcels located off of SR 248 . A ninth small parcel, owned by Hillcrest Investment, is located at the northwest intersection of SR 248 and US 40. The properties are located in Sections 28, 33, 34, and 35, Township 1 South, Range 4 East and in Sections 2 and 3, Township 2 South, Range 4 East, Salt Lake Base and Meridian, Summit County, Utah. Requested zoning is Recreation Open Space (ROS) for the majority of the properties, including all open space and conservation easement areas, with Light Industrial (LI) zoning requested for four of the small parcels. There are no development plans at this time for the annexation area. On March 21, 2013, the Park City Council accepted the annexation petition. The City Recorder certified the annexation petition on April 22, 2013. The complete annexation petition is available for inspection and copying at the office of the Park City Planning Department located at 445 Marsac Avenue, Park City, Utah. Park City may grant the petition and annex the area unless (1) a written protest to the annexation petition is filed with the Summit County Boundary Commission, c/o Summit County Clerk at 60 North Main Street, Post Office Box 128, Coalville, Utah 84017 on or before May 31, 2013 and (2) a copy of the protest is delivered to the Park City Recorder at 445 Marsac Avenue, Post Office Box 1480, Park City, Utah 84060 on or before May 31, 2013. The area proposed for annexation into Park City will also automatically be annexed to any local district providing fire protection, paramedic, and emergency services, as provided in UCA Section 17B-2-515.5, if: (A) Park City is entirely within the boundaries of the local district: (1) that provides fire protection, paramedic, and emergency services; and (2) in the creation of which an election was not required because of Subsection 17B-2-214(3) (c); and (B) The area proposed to be annexed into Park City is not already within the boundaries of the local district. The area proposed for annexation into Park City will be automatically withdrawn from any local district providing fire protection, paramedic, and emergency services, as provided in Subsection 17B-2-601(2), if: (A) The area proposed for annexation is within the boundaries of a local district: (1) that provides fire protection, paramedic, and emergency services; and (2) in the creation of which an election was not required because of Subsection 17B-2-214(3) (c); and (B) Park City is not within the boundaries of the local district. NOTICE OF BONDS TO BE ISSUED NOTICE IS HEREBY GIVEN pursuant to the provisions of Sections 11-14-316 and 11-27-4, Utah Code Annotated 1953, as amended, that on May 2, 2013, the City Council (the "Council") of Park City, Utah (the "City"), adopted a resolution (the "Resolution") in which it authorized and approved the issuance of its general obligation bonds (the "Bonds"), in the aggregate principal amount of not to exceed Nine Million One Hundred Five Thousand Dollars, to bear interest at a rate or rates of not to exceed four percent per annum, to mature over a period not to exceed fifteen years from their date or dates and to be sold at a discount from par, expressed as a percentage of the principal amount, of not to exceed one percent. Pursuant to the Resolution, the Bonds are to be issued for the purpose of acquiring, constructing, improving and modifying pathways, roads and related improvements for use by pedestrians and cyclists (the "Project") and refunding all or a portion of the City\'s currently outstanding General Obligation Bonds, Series 2003 (the "Refunded Bonds"). The estimated total cost of the Bonds is $10,276,000. The City proposes to pledge the full faith and credit of the City for the payment of its general obligation bonds and may be obligated to levy and collect ad valorem taxes without limitation as to rate or amount in order to pay the general obligation bonds, as provided by law. The total par amount of the City\'s currently outstanding general obligation bonds (excluding the Refunded Bonds) is $27,455,000. More detailed information relating to the outstanding general obligation bonds of the City is available from the City Treasurer. The Bonds are to be issued and sold by the City pursuant to the Resolution. A copy of the Resolution is on file in the office of the City Recorder of the City, located in the Marsac Municipal Building, at 445 Marsac Avenue, Park City, Utah, where the Resolution may be examined during regular business hours of the City Recorder from 8:00 a.m. to 5:00 p.m. The Resolution shall be so available for inspection for a period of at least thirty days from and after the date of the publication of this notice. NOTICE IS FURTHER GIVEN that pursuant to law for a period of thirty days from and after the date of the publication of this notice, any person in interest shall have the right to contest the legality of the above-described Resolution (including the final bond resolution attached thereto) of the City or the Bonds authorized thereby or any provisions made for the security and payment of the Bonds. AMENDMENTS TO TITLE 5, CHAPTER 2 OF THE SUMMIT COUNTY CODE, CRIMES AND OFFENSES; AMENDMENTS TO TITLE 1, CHAPTER 13 OF THE SUMMIT COUNTY CODE, ADMINISTRATIVE CODE ENFORCEMENT HEARING PROGRAM; REPEALING TITLE 5, CHAPTER 4, SECTION 10 OF THE SUMMIT COUNTY CODE, RECOVERY OF COSTS FOR RESPONDING TO EMERGENCIES ORDINANCE NO. _803_ PREAMBLE WHEREAS, the County Council finds that it is unlawful for persons to knowingly make a false alarm for a fire or medical emergency, release a hazardous substance, or recklessly cause a fire in Summit County, Utah; and, WHEREAS, the recovery of the costs associated with emergency responses to false alarms, releases of hazardous materials, and reckless burning is of importance to the citizens of Summit County so as to ensure personal accountability of the perpetrator and the safeguarding of the public treasury from unanticipated expenditures which reduce the ability of the County to provide needed services; and, WHEREAS, modifications are needed to the Summit County Code to impose criminal penalties for knowingly making a false alarm, releasing a hazardous substance, or recklessly causing a fire, and establishing an administrative process for recovering the costs associated with responding to and remediating consequences of these criminal actions; and, NOW, THEREFORE, the County Council of the County of Summit, State of Utah, ordains as follows: Section 1. Amendments. Crimes and Offenses, Title 5, Chapter 2, and the Administrative Code Enforcement Hearing Program, Title 1, Chapter 13 of the Summit County Code are amended in accordance with Exhibit A herein. Section 2. Repealer. Recovery of Costs for Responding to Emergencies, Title 5, Chapter 4, Section 10 of the Summit County Code is hereby repealed in accordance with Exhibit A herein. Section 3.
